Rojales youth broke bone in his baby’s arm

The Provincial Court of Alicante has convicted a juvenile boy of aggravated assault, for mistreating his baby son, who was barely a month old when it happened in the summer of 2013, according to the sentence published by the Superior Court of Justice of the Valencian Community (TSJCV).

It was last August when the accused shook and pinched the baby with force, producing a bruise on the cheek.

The most serious attack though was at the beginning of September 2013, when the young man caused a “transverse fracture without displacement of the humerus on the right arm”, which, along with other fractures of the ribs, “took 60 days to heal”.

In March this year he was convicted by the Alicante Court for Minors Nº1 and sentenced to “three years in prison followed by two years of probation for one count of habitual mistreatment, two counts of aggravated assault and another two of familial mistreatment”.

But after presenting an appeal, the Provincial Court reduced the punishment as it did not consider the minor to be guilty of causing all the fractures.

In the end, the youth must spend two years interned in a centre and another year and a half on probation. In addition, he must also pay compensation for “moral damages” of €4,920.
